AB 495 is Good for California

We support California AB 495, known as the Toxic Free Cosmetics Act. Existing law, the Sherman Food, Drug, and Cosmetic Law, prohibits the manufacture, sale, delivery, holding, or offer for sale of adulterated cosmetics, and prescribes when a cosmetic is adulterated, including when it bears or contains a poisonous or deleterious substance that may render it injurious to users when used as directed in the cosmetic’s labeling or advertising or under customary or usual conditions.
The Toxic Free Cosmetics Act in California is an important step in consumer protection. While new legislation (the Personal Care Products Safety Act) introduced at the federal level would require testing of ingredients for safety at a rate of 5 ingredients annually, California takes the bold step in acknowledging the named ingredients as carcinogenic and would ban their use in products sold in the State of California – leading the way for the country.
AB 495 would additionally prescribe in California that a cosmetic is adulterated if it contains asbestos, lead, or any of several specified intentionally added ingredients, including:
(m) Per- and Polyfluoroalkyl substances (PFAS).
California always leads the way for the nation in terms of consumer protection and by supporting this bill we believe the rest of the country will act to ensure personal care products are free from harmful ingredients.
